Declaración de obra nueva por antigüedad in the Canary Islands

You have a construction that is not correctly recorded in the title deed: a dwelling, a tool shed, a lounge, a premises, a house on rural land, a porch or another building. When the legal requirements are met, the declaración de obra nueva por antigüedad (registration of an existing building based on its proven age) allows the construction to be technically documented for its subsequent notarial formalisation and registration at the Land Registry. The work may include measurement, plans, a technical report, a measurement certificate, proof of age and the graphic documentation needed for Catastro and the Land Registry. For dwellings, depending on the case, documentation on habitability conditions may also be required.

  • There is a construction on your plot that appears neither in the deed nor in Catastro.
  • You are going to sell and the buyer or their bank asks for the construction to be documented.
  • You have inherited a plot with undeclared buildings.
  • You want to tidy up your property's documentation before the problem arises.

What problem it solves

The declaration of new construction is signed before the notary and registered by the Land Registry; our part is the technical one: measuring the construction, drawing it, georeferencing it and producing the certificate describing what exists, how much it measures and since when it is known to exist, according to the available evidence.
